Abstract

In can. 209 § 1 CIC/83, it is stated that there is a duty to always faithfully maintain communion with the Church. On the other hand, every human person has the right to religious freedom. This means that no one can be forced to profess and practice the faith. A negative example of human religious freedom, i.e., the possibility of choosing or rejecting religion, is defined in can. 751 CIC/83 as the crimes of apostasy, heresy, and schism, which can be effected by a formal act. The purpose of this paper is to present the formal act of leaving the Church as a negative manifestation of religious freedom and the effects it entails.
