Legal certainty and speed of procedure are fundamental principles of the Polish Code of Administrative Procedure. Its latest amendment constitutes an attempt to introduce another institution into the Polish legal system, which is supposed to prevent the administration from idle. The aforementioned institution - construed as a part of procedural law - is the tacit decision. It has previously functioned within the substantive law provisions. The purpose of this paper is to point out - based on case law analysis - how difficult it is for the lawmaker to find legal solution which will ensure legal certainty by means of uniform judgments.
