The right of persons deprived of liberty to religious practices

Abstract

Religious freedom is one of the basic rights of every person, regardless of their religion or worldview. One of the elements of religious freedom is the right to perform religious practices regardless of personal situation and place of residence. According to Polish legislation the right to religious practices belongs to every human being, including the person in the conditions of penitentiary isolation. The aim of the article is to analyze Polish legal regulations in the field of rights of a convicted person as a result of execution of a prison sentence taking into account the penalty of imprisonment executed under the electronic surveillance system or applying a preventive measure in the form of temporary arrest, drawing attention to problems in the implementation of this right.
