Freedom to marry and the impediment of ligamen in Polish and Canonic Law

Abstract

This article presents the issue of the freedom to marry - the ius connubii - which is one of the fundamental rights of every believer and citizen. However, this ius suffers restrictions in specific circumstances for the protection of the legitimate matrimonial knot, the rights of the other spouse and the emerging family. One such limitation, introduced by both state and canon law, is the obstacle of the matrimonial knot. The study provides a comparative analysis of the norms concerning the prohibition of the marriage knot, considering both legal systems. Furthermore, it points out the interpenetration of these impediments in both legal systems, which may consequently lead to dualism in marital relations.
