The article is an attempt to show exclastration as an institution that protects rights a given monk, as well as the laws of the entire institute. Discussing the origins and history of the development of the discussed institution allowed us to see how, over the centuries, religious legislation, which was primarily responsible for the protection of community life, began to recognize the rights exclustered and take care of his identity as a monk. However, the analysis of the different varieties of exclaustration that occur today The Code of Canon Law will allow us to see that monastic life is very rich and diverse, which is related to the fact that church legislation notices this gift and seeks it the best possible solutions for a specific religious structure. For the legislator it is not indifferent charisma of monastic life, but most concerned about the well-being of everyone religious institute. This is particularly evident when discussing who can provide indult of exclaustration and on what terms. These distinctions into different entities responsible for granting the indult show how even the temporary departure of a monk interferes in the life of a given religious community and how much responsibility it takes on the one who grants this indult.
