Abstract

The marriage annulment process has been shaped over the centuries. Individual legislators wishing to make it easier for spouses to realize their freedom to know the truth about their marriage have tried to modify the de nullitate matrimonii procedure so that it properly helps answer the doubt about the validity of the contested marriage. In 2005, the procedural instruction Dignitas connubii was issued to help employees of Church tribunals apply matrimonial procedural law in marriage annulment cases. In 2015, Pope Francis made a sweeping reform of the process de nullitate matrimonii. Thus, the question arose about the status of the procedural instruction Dignitas connubii after the apostolic letter motu proprio Mitis Iudex Dominus Iesus in light of the new provisions of the Code of Canon Law. This article is an attempt to solve this problem.
