The purpose of this article is to analyze canonical marriage as a legal institution expressing man’s fundamental right to freedom in choosing the state of life. In the view of canon law, marriage is a covenant entered into voluntarily by a man and a woman, and its validity is based on the freely expressed consent of the parties (canon 1057 § 1 CIC). The author discusses the norms of the Code of Canon Law regarding the freedom to enter into marriage, with particular emphasis on the nature of the act of marital consent, obstacles and defects in marital consent. The article emphasizes the need for full awareness and voluntariness of the act of marriage as a legal act with a profound personal and communal dimension. The article shows that in the light of canonical norms, marriage is an expression of man’s personal freedom in choosing the state of life.
