Abstract

The author’s arguments in this study focus on the subject of the legal value of a grave inconvenience in the context of the functioning of the extraordinary form of marriage (can. 1116 CIC/83). Assuming an integral vision of the issue in question, the Author has considered it in a broader context, which he considered to be, on the one hand, the presentation of the responses of the organs of the Roman Curia, i.e. the Pontifical Commission for the Authentic Interpretation of the Canons of the Code and the Congregation for the Sacraments, and, on the other hand, the course of the codification work on the revision of the 1917 Code.

Regarding the concept of the category of grave inconvenience, he showed that, in the material sense, it refers to both the qualified witness and the nupturients; modern doctrine does not exclude reference to a third person either. The attribute of grave inconvenience is associated by commentators with both physical and moral impossibility, maintaining that moral impossibility should be considered sufficient.
