This article addresses the issue of biomass usage in the installations covered by the objective scope of EU ETS, from the perspective of legal solutions aimed at motivating entities to use biomass as a fuel in order to limit the impact of their activity on climate. The authors take into consideration some measures adopted under the directive of the European Parliament and of the Council (EU) 2018/2001 on the promotion of the use of energy from renewable sources. Additionally, general rules of EU ETS functioning were explained, as well as the requirements of qualifying installations to participate in the scheme, with a focus on biomassusing
installations. The issue of charges for carbon dioxide emissions from biomass combustion paid by operators of installations covered by the EU ETS under the Environmental Protection Law Act was also analysed.
