Abstract

The article discusses the issue of admissibility of collecting computer data for the purposes of criminal trial in conjunction with selected elements of the right to privacy. It presents basic issues related to the protection of private and family life, protection of correspondence and their limitations in the European systems for the protection of human rights. The author analyzes selected judgments of the European Court of Human Rights in Strasbourg regarding the violations of the right to respect for private and family life and the right to correspondence in the context of computer data collection procedures. Furthermore, the issue of compliance of Polish law with the standards developed in the case law of the Court is assessed, as well as their impact on the implementation of the criminal law’s basic principles, and proposals for changes in this area are presented.
