Abstract

If employer has incorrectly terminated the employment contract without notice, employee is entitled to two alternative claims. First require should be request for reinstatement on previous working conditions. In the meantime employee also can demand compensation for the
duration of unemployment, which was restricted by the legislator, however these limits do not apply to certain categories of employees, such as pregnant women. In this case the salary is paid for the entire period of unemployment. The condition for returning to work and getting
paid for the time of unemployment is employee notification of willingness to work within 7 days. Second privilege instead of an employee requests to return to work is a claim for compensation.
