The aim of the publication is to present the issue of the provisions of a local spatial development plan influencing the qualification of a given property as an agricultural property under the law covering the agricultural lands’ transactions. First of all, the article presents a local spatial development plan as a planning act. In comparison, there are described also other acts typical for that area of law. Then, the publication clarifies a definition of an agricultural property, as well as the issue why under the definition a local plan became one of the factors qualifying a given property as an agricultural property. However, this definition does not eliminate complicated factual situations when different parts of a property meeting the requirements of an agricultural property under the Civil Code are intended for other purposes under a local spatial development plan. The publication also refers to the positions of science and practice in the above field.
