Abstract

The article is a commentary to the judgment of the Supreme Court of 25.8.2004, reference number IV CK 609/03 regarding the influence of the change of religion of one of the spouses on the breakdown of marital and legal life of the consequences, with particular emphasis on the "guilt" of the spouse. The author approves the position of the Supreme Court with some
modifications and tries to prove that a change of religion or belief may result in the breakdown of marital life, and consequently may be qualified in the legal institution of
divorce guilt.
