This publication is a review of the victim's status in private penal prosecution, to which the prosecutor joined, changing its status to public. This role, as it turns out, is substantial, so it
is valuable to summarize the rights and duties of the victim in a criminal trial, conducted in such a mode. The aim of the article is a comprehensive, critical analysis also by comparison
the status of the aggrieved party in pure form with the victim in ordinary public proceedings. The considerations in the article are based, among other things, on the attempt to determine
which of the possible roles of the victim in the criminal trial is more favourable, since the status of victim in those procedural situations slightly differs.
