Abstract

The article is an attempt to determine the owner of the capital granted under a foreign currency credit granted in Swiss francs. The purpose of the article is to analyze and discuss the issue of annulment of foreign currency credit agreements in the case law of common courts and to assess the legitimacy of banks' claims against the plaintiffs (clients) to whom Swiss franc financing was granted.
