Secular "Sacralizations" of the Statutory Law

Abstract

The article starts with the observation that already in antiquity it
was understood that law means more than statutory law, which by its nature is subject to change, whereas law, in the sense of what is righteous, “is eternal and unchangeable.” By presenting the discovery of natural law as a crucial stage in the process of secularization, the Author argues that the legal positivism that is gaining popularity today has been accompanied by the process of desecularization of law. Within its framework, there is a new attempt to treat statutory law as of “divine” nature, which may create a totalitarian threat from democracy.
