Incapacitas assumendi (can. 1095 CIC) in the light of the judgment of the Roman Rota c. Da Costa Gomes of July 17, 2023

Abstract

The author presents the sentence of the Roman Rota regarding the marriage concluded by the parties on August 23, 1997
in one of the parish churches in the Sosnowiec diocese. The marital community, without offspring, lasted about eight years,
after which the man filed (December 8, 2019) to the Diocesan Court of Sosnowiec a lawsuit for the declaration of the invalidity
of the marriage due to the inability to assume the essential obligations of marriage for causes  of a psychic nature (can. 1095, n. 3 CIC) after the defendant.
After conducting the evidentiary instruction and performing other procedural steps, on April 12, 2022, the Tribunal issued a negative sentence,
from which the plaintiff appealed to the Roman Rota, where - after completing the evidentiary instruction – shift the judge's c. Da Costa Gomes on July 27, 2023 ruled constare de nullitate.
