Partial appeal in the proceedings for declaration of nullity of a marriage

Abstract

The article addresses the issue of partial appeals in the proceedings for declaration of nullity of a marriage. It analyses various decrees issued by judges of the Tribunal of the Roman Rota. Particularly, it provides a wide spectrum of the cases whereas a party or parties have filed a partial appeal. Frequently, such appeals tend to be treated as a potential instrument for dilatory (mere dilatoria). For this reason, in such cases it is possible to deliver the judgment on the other grounds of nullity of a marriage, according to the principle of procedural economy.
