Total simulation and exclusion of Goods of Marriage in the sentence of the Roman Rota c. Bottone of 8 March 2012

Abstract

This article is a commentary on the Roman Rota sentence coram Bottone of 8th march 2012. The case concerned total simulation of marital consent and exclusion of good of offspring, faith as well as a sacrament and in the Roman Rota was examined in the third instance. Interesting element of the sentence is that in each of the three instances the verdict was affirmative, but in each case was declared on a different reason (In the first one, its nullity was based on the total simulation established on behalf of a petitioner. In the second one – it was an exclusion of good of faith by the petitioner. In the Roman Rota the positive verdict was based on a proof of the exclusion of good of faith and sacrament also by the petitioner). The analysis of the sentence is the example of a reliable and accurate evaluation of evidence collected in this case.
