Abstract

The author discusses and comments on the judgment of the Roman Rota of November 18, 2013 (non constare) in the case of nullitatis matrimoniidue to the exclusion of bonum coniugum on the part of the woman and the exclusion of the indissolubility of marriage by the plaintiff. After the defendant's appeal to the Roman Rota, the Tribunal issued criminal sentences on both counts. The justification for this judgment in relation to the bonum coniugum deserves special attention.
