Achievements of Canon Studies at the Catholic University of Lublin on Material Matrimonial Law During the Interwar Period (1918-1939)

Abstract

In the presented study, the author's attention was focused on the issue of the canon studies of the Catholic University of Lublin on material matrimonial law during the interwar period (1918-1939). Investigating the material legacy of the published monographs of employees and students of this scientific center, their collective works and articles, he proved that these scholars categorically opposed the governmental lay reform project of personal marital law, defending Catholic marriage teaching. It was expressed especially in two positions which were collective works: "Marriage in the Light of Catholic Teaching" and "Critical Division of the Draft Marriage Law Passed by the Codification Commission".

Addressing the substantive level of the publications, the author showed that they are based on solid source material and literature on the subject. It is the author's opinion that special attention should be paid to: doctoral thesis by Piotr Bober "The Concept of a Secret Marital Obstacle in Canon Law" and bachelor thesis by Teodor Bensch "The Influence of Mental Illness on the Validity of a Marriage Contract in Canon Law'. In both texts, the canonists took up the subject matter which in those times was thoroughly innovative, concluding the results of their research with reliable summaries.
