The canonical status of marriages in assisting the priests of the Priestly Fraternity of Saint Pius X (FSSPX) after the issuance of the letter of the Pontifical Commission Ecclesia Dei of March 27, 2017

Abstract

On the initiative of pope Francis, by the letter of the Pontifical Commission Ecclesia Dei of March 27, 2017, norms were introduced for granting delegation to priests, before whom the faithful attached to the Priestly Fraternity of Saint Pius X wish to marry. The priests of this community, which is part of the Catholic Church, are canonically irregular and do not have the status of ordinary or parish priest. So they need the required delegation ad validitatem to assist in getting married. In the light of the document under discussion, such a delegation is issued by the local ordinary. The community, using the issued regulations, maintains the thesis that marriages contracted before a priest of the FSSPX without delegation, referring – due to the situation of the Church after the Second Vatican Council – to the extraordinary canonical form of marriage and to a common error, as well as a positive and probable doubt in the light of can. 144 of the Code of the Canon Law of 1983. The Holy See, in the documents issued by the Pontifical Commission Ecclesia Dei and the decrees and sentences of the Tribunal of the Roman Rota, maintains the position that these marriages are contracted invalid due to the lack of a canonical form.
