Institution of incidental appeal in the system of canon law

Abstract

An appeal is an institution that is well known and is often used in litigation. However, the legislator also provided an incidental appeal, which may be filed by the defendant after being notified of the main appeal. The subject of this article is the analysis of the functioning of this institution in the ordinary litigation process, as well as in proceedings for nullity of marriage. These considerations include both theoretical issues related to the proper understanding of the incidental appeal, as well as special situations: the possibility of a litigation party changing its position, challenging the title by the defendant or the possibility of an incidental appeal by the defender of the marriage bond.
