Abstract

Plea Bargaining and Conviction Without Trial: a Critical Perspective on Negotiations with Prosecutors in Poland and the USA The article presents a comparative legal analysis of consensual institutions concluding criminal proceedings in Polish and American law. Based on jurisprudence and statistics from both countries, the article examines the benefits related to the efficiency of proceedings as well as the drawbacks of both systems, particularly concerning potential pressures on defendants to plead guilty and the types of crimes and their social harm. Through the comparative analysis, the article synthesizes key similarities and differences in the approach to procedural agreements in common law and civil law systems. The implications of implementing both institutions are also discussed, both for judicial practice and the further development of legal theory, with a special focus on potential reforms and adaptations of the solutions. The article also describes the factors influencing current trends in the use of plea bargaining in countries and evaluates them from the perspective of the role of the criminal process.
