The controversy over a contract for aid at harvest

Abstract

In the Act of 13 April 2018 amending the Act on social insurance for farmers and some other Acts, the Polish legislator introduced a new type of contract - a contract for aid at harvest. Although it refers to the performance of specific activities for the benefit of the farmer, and thus concerns employment in the economic sense, it is not a type of labour contract. The construction of the contract does not provide a guarantee of the right to occupational safety and health at work (in the area of, for example, working time, rest at work or standards regarding lifting). Therefore, it raises doubts as to the compliance with art. 66 of the Constitution of the Republic of Poland and the so-called framework directive on health and safety. The construction of the contract for aid at harvest also seems to contradict the objectives set out in the European Pillar of Social Rights.
