The objection against the cassation decision as novum in the administrative court procedure

Abstract

The cassation decision is the institution of an administrative procedure of a control nature. Area-long described in Article 138 of the Code of Administrative Procedure. At the time of its application by the appeal body, the matter may be referred back. In order to avoid the situation of excessive application of this institution, the amendment of 1 June 2017, the objection against the issued cassation decision, which the party has the right to bring to the administrative court. This article focuses on evaluating the subject, regarding the procedural rights of the party. The cassation decision is the institution of an administrative procedure of a control nature.
