    Abstract

    This publication aims to discuss the regulation contained in article 131a of the Bankruptcy law, being a response to the legal gap existing until 2019 in the field of protection of the debtor's personal creditors during bankruptcy proceedings in relation to restructuring proceedings. Critical analysis will also include the principles of applying the above novelty in bankruptcy law, with the author's simultaneous assessment of the introduction of article 131a of the bankruptcy law in connection with the planned amendment in the above scope.
