The procedure of pardon in the polish Code of criminal procedure

Abstract

The article presents the institution of pardon as a constitutional prerogative of the President of the Republic of Poland, characterized as personal and not requiring a countersignature. The author discusses its historical development within the Polish legal order and traces its institutional and procedural evolution. The analysis focuses on the current constitutional framework and provisions of the Code of Criminal Procedure, with particular attention to the roles of the court and the Prosecutor General in pardon proceedings. The article compares the pardon with the institutions of amnesty and abolition, emphasizing its individual and discretionary nature. It also outlines the formal requirements for submitting and processing pardon requests, the scope of presidential discretion, and the function of the pardon as an expression of humanitarian considerations within the system of criminal sanctions.
