Abstract

The study is another contribution to exploring, through an analysis, the substantive wealth of judgments of the Roman Rota judges in cases for nullity of marriage due to the exclusion of indissolubility. It is an attempt to collect and present selected legal principles concerning the circumstances of the case, which are formulated by the members of the ordinary tribunal established by the Roman Pontiff for receiving an appeal (can. 1443 CIC/83). The following remarks on proving in cases of nullity of marriage ob exclusionem boni sacramenti, taking into account, as John Paul II wants, "specific conditions of each individual relationship", constitute a continuation of the considerations contained in the article entitled "Study of the circumstances that help to establish the thinking and will of the alleged simulator in cases of nullity of marriage ob exclusionem indissolubilitatis".
