Selected crimes and offenses against wild animals in Poland – criminal law approach

Abstract

This article presents a criminal law analysis of selected crimes and offenses against wild animals in the Polish legal system. In the article Author focuses on the dogmatic analysis of the crime of environmental destruction typified in art. 181 Penal Code also protecting wild animals, art. 127a of the Nature Protection Act, which criminalizes the illegal acquisition of animals, plants and mushrooms under protected species and offenses specified in art. 164 and 165 Code of Offences aimed at the undisturbed existence of wild animals. The criminal law analysis carried out during the considerations undertaken in the article ends with a concise expression of the Author’s conclusions and comments and presentation of de lege ferenda postulates related to the discussed legal norms.
