Abstract

This article is devoted to the matter of the art's counterparty as a circumstance excluding the unlawfulness of an offense of offending religious feelings from Art. 196 the Criminal Code.
The study is a presentation of the doctrine's view and the position of jurisprudence on a given topic. The author of the study postulates the attachment of an art counterparty in the act.
Arguing that a precise definition of the hallmarks of this institution will help fair settlement of the dispute between artistic freedom and religious freedom, which is the essence of the in
the development of matter.
