Particularly irreverent larceny as an irrational idea of the legislator

Abstract

Regulations concerning particularly irreverent larceny, have put them into question already in the last century when this criminal offence was introduced to the Polish legal
system for the first time. Reintroduction of such criminal offence in 2020, could not pass unnoticed among law professionals. The thesis concentrates on regulations of particularly irreverent larceny in the Polish Penal Code. The aim of the thesis is an evaluative analysis of potential aftereffects of reintroducing this criminal offence, examples of the regulation in practice and their analysis, as well as starting discussion about the sense of reintroducing given regulation, which, as it turned out, did no good in the past. The thesis focuses also on many irregularities, which took place already during the legislative process. Furthermore, indications of the legislator’s lack will be also covered. Authors address problems that could be caused by putting in effect this new regulation, including similarities to some other criminal offences of rationality and lack of protection for the fundamental functions of the Criminal Law,
