Threats and challenges in protecting the right to privacy and respect for bodily autonomy

Abstract

This article presents selected threats and challenges in the protection of the right to privacy and respect for bodily autonomy. The key issue in the first part is the apparent consent of patients and users to the processing of personal data. In addition, the need to introduce measures that will ensure real awareness and voluntariness in the process of expressing consent is indicated. At the same time, issues related to the development of new technologies are analyzed, and the impact of biometric systems and wearable technologies on bodily integrity is discussed. Then, the issue of violations of self-determination about one's own image in the media space is raised, primarily the problem of creating an idealized body image and objectification of women through the way they are presented in advertisements is discussed. The last part of the article brings closer the phenomenon of institutional violence, including the lack of effective mechanisms for the legal protection of people whose bodily integrity has been violated. The need for systemic solutions is indicated, including the expansion of personal data protection systems and employee training.
