The transfer of development rights by Zoning Lot Merger in the New York City Zoning Resolution

Abstract

This article discusses the NYC regulations related to the Transfer of Development Rights (TDR) mechanism by Zoning Lot Merger. This mechanism is straightforward and free of unnecessary formalities, which makes it the basic, but not the only way to transfer development rights from one parcel of real estate to another. Under its provisions, the owner of the real estate from which the unutilized development rights are to be transferred makes a contractual self-limitation on the further development of his real estate. The buyer can add this potential to his own investment, and as a result may construct a building with parameters exceeding the provisions of the zoning resolution for the particular area. New York City’s TDR is generally considered a model legal regulation in other parts of the USA and has been adopted by other state jurisdictions.
