Abstract

The subject of this study is an unpublished sentence of the Apostolic Nunciature Rota in Spain (the Spanish Rota) dated January 22, 2022, concerning the grave defect of discretion of judgment regarding  the essential matrimonial rights and duties mutually to be given and accepted. The sentence is interesting due to the fact that it concerns the plaintiff's dependence on her mother and is examined under canon 1095, §2 of the CIC/83.The aim of the research is to analyze the sentence coram Morán Bustos (the plaintiff's dependence on her mother) in terms of the ground of nullity of marriage regarding the grave defect of discretion of judgment concerning the essential matrimonial rights and duties mutually to be handed over and accepted. Methods an exegetical-analytical approach. The value of the sentence also lies in the legal reasoning provided by the rapporteur – Carlos Manuel Morán Bustos. He points out that the marital realization of love is nothing other than a response to the specific calling to be a man and a woman within the framework of a committed project for the future. The “proportional” evaluative judgement, which arises from the subjective psychological assessment of the individual and the objective nature of marriage, is presumed to be normal in spouses. In fact, until proven otherwise, it is assumed that a person is presumed to be normal and capable of everything to which their nature inclines them, namely, marriage. To determine the existence of a serious lack of sentence on the part of the person making decisions at the time of entering into marriage, the seriousness of such a defect must be proven: in reality, such an anomaly must be truly serious in order to conclude that in decisions of the greatest importance, the person is completely dependent on others to such an extent that they do not make these decisions with sufficient prudence and/or sufficient independence. The study is divided into three chapters: the state of affairs, the legal situation, and the factual situation.The sentence coram Carlos Morán Bustos of January 22, 2022, provides valuable de iure insights . It also contributes to the consolidation of the jurisprudential line of the Roman Rota. One should hope that it will be a useful tool in the judicial service of diocesan Tribunals, which are more often classified under  canon 1095, 3 of the CIC/83.
