Abstract

The judgment of the Court of Justice of the European Union in Paks II (Case C-59/23 P) concerns the compatibility with EU law of State aid granted for the construction of a nuclear power plant in Hungary. The Court held that the European Commission erred in confining its assessment to the State aid rules while failing to consider the relevance of the EU public procurement rules. The central issue in the case was the application of the concept of the “inseparable aspects of State aid”, under which provisions of EU substantive law that are closely linked to the objective pursued by the aid must also be taken into account when assessing its compatibility with EU law. The Court found that the procedure for awarding the contract for the construction of the reactors formed an integral part of the aid measure and could have affected both its cost and its structure. Accordingly, it set aside the judgment of the General Court and annulled the European Commission's decision. The judgment underscores the need for a comprehensive assessment of State-funded projects to ensure their compliance with all applicable provisions of EU law. The commentary also discusses the potential implications of the judgment, particularly for the development of the European Union's climate and energy law. The study employs doctrinal and theoretical legal methods.
