In search of "res iusta matrimonii": canon law towards the challenges arising from legal deconstruction of marriage

Abstract

The socio-cultural changes taking place in the contemporary world, coupled with the positivism dominant within secular legal systems, have led to the legal deconstruction of marriage. The traditional and natural model of marriage has been questioned. Marital indissolubility, heterosexuality, openness to life, and the traditional model of childbearing, derived from Roman law, have lost their fundamental significance. For many, including the faithful of the Church, marriage becomes a reality promulgated by a secular legislator. In this context, marriage appears as an act of celebration or the formalization of feelings or emotions. In the search for objective truth, it is necessary to abandon positivism and resort to legal realism, which, based on natural law, will allow for the establishment of the internal and natural legal dimension of marriage. Its foundation is anthropological truth, inscribed in the order of salvation, and the truth of salvation. The legal dimension of marriage is based on elements stemming from the nature of things and common to all humanity: the dignity of the human person, the duality of sex, and the complementarity of man and woman. Referring to the legal dimension allows for the further development of the legal anthropology of marriage.
