The Littera commendatitiae (commendatory letter) – Is it Solely a Means of Protecting the Sanctity of the Most Holy Sacrifice and the Sacrament of the Eucharist?

Abstract

The problem addressed: Church law places great importance on ensuring that Mass is celebrated validly and licitly. Therefore, regulations are issued that govern, among other things, the authorization of priests who are not known to the rector of a given church to celebrate Mass. This article attempts to answer the questions of whether the current regulations regarding the littera commendatitiae are sufficient today for effective protection of the Eucharist, and also about the role of the littera commendatitiae in contemporary realities.

The aim of the research conducted: The purpose of this study is to examine the legal texts concerning the role of the littera commendatitiae in the context of a valid and licit celebration of Mass, and to answer the question of whether the role of the codex-based littera commendatitiae should be expanded to other areas in today's circumstances.

Methods: The study primarily employs a dogmatic-legal method, as well as analytical and synthetic methods, and partially a historical method.

The results of the research: Regulations regarding the littera commendatitiae date back to ancient Christianity. The current Code of Canon Law (CIC) adopts the law on the littera commendatitiae from can. 804 of the 1917 CIC, but significantly simplifies it. It must be stated that the role of the littera commendatitiae in current canon law is insufficient in today's circumstances.

The conclusions drawn from the research: Based on the analyses conducted, it should be noted that in the age of technological development and the high mobility of clergy, the littera commendatitiae in the form of a codex-based "commendatory letter" is insufficient, and its annual renewal makes it even less reliable. It should be modernized to become a more effective tool in protecting the Eucharist. Today's littera commendatitiae should be a certificate of a priest's ability to celebrate other sacraments and other acts of divine worship. The littera commendatitiae should also include references to the protection of children and adolescents from sexual abuse by clergy. Therefore, a "modern" littera commendatitiae should be "expanded" to also address the issue of ensuring safety within the Church.
