Notitia criminis – Verification and Its Consequences

Abstract

The problem addressed: The article addresses the issue of verifying notitia criminis, emphasizing its importance for the proper response of ecclesiastical authority to information concerning a possible offence.

The aim of the research conducted: The aim of the study is to determine the legal nature of such verification, its criteria, and the consequences of both positive and negative outcomes.

Methods: The dogmatic-legal method was employed, supported by an analysis of codified norms, special legislation, and canonical doctrine.

The results of the research: The study establishes that verification is not a merely technical act, but a legally significant stage preceding further proceedings. Its criteria include probability, legal relevance, specificity, assessment of the source, and verifiability of the information.

The conclusions drawn from the research: The verification of notitia criminis performs both a protective and a guarantor function, safeguarding the common good of the Church and injured persons, as well as the rights of the reported person.
