Abstract

The article discusses the need to take into account civil law concepts and regulations when interpreting the provisions on the right to dispose of real estate forconstruction purposes. The author attempted a comprehensive analysis of theconstruction of this right in the context of legal titles to real estate. The purpose ofthe study was to systematize this construction and identify interpretative disputesin the literature and case law. The research was based on a dogmatic-legal analysis,taking into account the body of doctrine and case law, which made it possibleto draw conclusions about the current regulations and to propose directions forlegislative changes.
