Canadian Models of Legal Aid in Light of the Canadian Charter of Rights and Freedoms

Abstract

Legal aid in Canada is one of the components of the country’s legal system and itsoperation fulfills the state’s obligations to citizens under the Canadian Charter of Rights and Freedoms. Providing legal aid to Canada’s low-income citizens is anessential public service. All the Canadian provinces and territories have developedtheir own publicly funded legal aid systems. The aim of this article is to examine Canada’s legal aid system. It is extremely important to consider the specifics of Canada’s systemic model (its federal nature, which means the country has as manyas 13 legal aid plans), but also its cultural and social context. An additional aim of this study is to present a series of legal guarantees specific for Canada, which have been enacted by parliament to guarantee fundamental rights regarding legalaid. The article presents the characteristics of several programs to show the wide range of legal aid available in Canada. The paper also attempts to assess the current condition of Canada’s legal aid system.
