Parents’ Profit Sharenting and the Protection of the Child’s Financial Interest

Abstract

The subject of this article is a specific form of sharenting called profit sharenting, whereby parents earn an income from posting their child’s picture on social media and the internet. It examines the provisions of Articles 91§1 and 101 of the Polish Family and Guardianship Code, and observes that not only are parents unaware that the scope of their child’s personal rights is the same as that of an adult, but also that by engaging in sharenting they are building up the child’s personal financial assets. Moreover, there is no obligation on small children to contribute to the costs of family maintenance. Other important issues addressed in the article include parents’ obligation to return the child’s property when it reaches the age of majority and the costs incurred by parents who benefit from profit sharenting.
