Abstract

This article presents my reflections on reading Dr. Radek Černoch’s monograph Falcidiánská kvarta, její recepce a § 1598 OZ (Te Falcidian Portion, Its Reception and § 1598 of the [Czech] Civil Code). Dr. Černoch presents the origins of the Falcidian portion in ancient Rome, how the ancient Romans applied it, and its reception afer the fall of the Western Roman Empire. However, his most interesting comments concern the introduction of the “Roman” solution into the Czech Civil Code in 2012. This move by the Czech legislature prompts reflection on the part of Polish readers, who may wonder whether it is not time to amend Article 961 of the Polish Civil Code.
