Abstract

This article examines the legal nature of proceedings concerning the annual review of perpetual usufruct fees in Poland. Perpetual usufruct is hybrid in character, combining some of the features of ownership and limited real rights, which is reflected both in Polish material law and in the mechanisms for the supervision of the annual fees. Disputes in this area oscillate and clash at the intersection of administrative and civil law, setting up a „processual boundary” and raising practical and interpretive problems.
