Collateral intervention by the child’s father in a paternity denial case

Abstract

This paper addresses the socially significant issue of the admissibility of a child’s father filing a collateral (secondary) intervention in a paternity denial case. This topic has raised doubts in the Polish legal doctrine for many years. While national jurisprudence has rejected the possibility of a child’s father filing a collateral intervention in a paternity denial case, the latest position of the European Courtof Human Rights seems to challenge this view. I am in favor of the admissibility of the child’s father fling a collateral intervention in a paternity denial case, for which this paper presents arguments, referring to publications on the matter and Polish case law.
