Administrative fines: a means to protect the individual’s well-being and the common good

Abstract

Questions about the purpose and effectiveness of administrative law are still cropping up. If we assume that the purpose of administrative law is the protection of basic values, the individual’s well-being and the common good, then we should consider the effectiveness of legal means through which this protection is implemented. Administrative fines are one of the most important measures in this respect. The aim of this article is to analyze the functions of administrative penalties and the requirements they should meet to serve as a realistic means to regulate social behaviour, and thereby offer a genuine protective measure. In my opinion, to make the system of fines not just a fictitious system, one of the key points both the legislator and public administration bodies should consider in the creation and application of appropriate legal regulations is the practical implementation of the preventive and repressive function of the system of fines. They should also take due notice of its suitability and enforceability.
