FORMOWANIE AMERYKAŃSKIEGO KOLEGIUM ELEKTORÓW

Abstrakt

Artykuł omawia proces kształtowania się systemu wyboru amerykańskiej władzy wykonawczej podczas konwencji konstytucyjnej i przebieg debat dotyczących tej kwestii. W dalszej części przedstawia się przebieg wyborów prezydenckich w latach 1788/9, 1792, 1796 i 1800, a następnie debat dotyczących wprowadzenia niezbędnych zmian w Konstytucji, zakończonych uchwaleniem XII Noweli. Szczególną uwagę poświęcono procesowi powstawania instytucji Kolegium Elektorów oraz regułom wyborów nadzwyczajnych.

W artykule wykorzystano zarówno zapis przebiegu konwencji konstytucyjnej, jak i zapisy dyskusji toczonych w trakcie procesu ratyfikacyjnego, a także kolejnych debat toczonych w Kongresie. W analizie uwzględniono dotychczasowy dorobek interpretacyjny badaczy amerykańskich, natomiast poruszana tematyka nie stanowiła dotąd przedmiotu opracowań naukowców polskich. Ponadto podano też pierwsze polskie tłumaczenie zasadniczego dla omawianej problematyki eseju Federalisty nr 68.
