Abstrakt

Artykuł przedstawia pierwsze polskie wydanie Fragmentum Dositheanum de manumissionibus – grecko-łacińskiego źródła z II/III w. n.e. powstałego na bazie niezachowanej pracy jurysty i koncentrującego się na problematyce wyzwoleń. Opracowanie obejmuje tekst źródła, przekład oraz komentarz historyczno-prawny do siedemnastu fragmentów – od podstawowych zagadnień jak podział prawa i formy wyzwoleń po bardziej złożone instytucje prawne jak servus sine domino, powtórne wyzwolenie (iteratio) czy starożytne kontrowersje wokół skuteczności manumissio censu. Publikacja udostępnia źródło poznania praktycznych aspektów rzymskiego prawa dotyczącego wyzwoleń oraz jego ewolucji w okresie pryncypatu – od prostego systemu trzech form wyzwoleń ku bardziej złożonej rzeczywistości Latynów juniańskich i wyzwoleń nieformalnych.
