The historical significance of the definition of the term ‘ius gentium’ proposed by St. Isidore of Seville

Abstract

The definition of the concept of ius gentium proposed by St. Isidore of Seville (c. 560-636) is one of the most interesting parts of Book Five of his Etymologies (Etymologiarum sive Originum libri XX). St. Isidore anticipates the understanding of the concept characteristic for early modern jurisprudence and constituting the foundation for the theory of contemporary public international law. The aim of this paper is to analyze the Isidorian definition from three perspectives. The first is to characterize St. Isidore’s definition, taking Roman juridical sources into account. The second looks at the political and social context of St. Isidore’s times. In the third perspective, the aim is to cover a broader historical panorama and focus on the reception of the Isidorian approach to the category of ius gentium in later times. This will help to make a thorough assessment of the historical significance of the definition of ius gentium proposed by St. Isidore of Seville.
