The participation of a defence counsel in interviewing a court expert

Abstract

The aim of this paper is to examine the role of a defence counsel in interviewing an expert witness during proceedings in court. A defence counsel acts as a “quality controller” of evidence in criminal proceedings and should take an active part every time an expert takes the stand. A defence counsel who has read an expert’s written opinion may question the expert and discredit or disprove his opinion if it is detrimental to the client. Such conduct on the part of defence counsels will improve the effectiveness of expert opinions in criminal proceedings and help the judge and/or jury assess expert evidence.
